Support Competition and Consumer Choice: Oppose HB 904

Kentucky took a bold step forward by creating a regulated sports betting system designed to protect consumers and generate vital state revenue. However, new legislation—House Bill 904—threatens to dismantle that progress. HB 904 is a step backward for the Commonwealth, picking winners and losers while placing our legal market at a severe disadvantage.

• HB 904 puts nearly $40 million in annual tax revenue at risk. This critical funding is desperately needed for better schools and public services to keep Kentucky moving forward.
• The proposed legislation risks forcing popular, licensed operators—platforms like Draft Kings and FanDuel that Kentuckians use and trust every day—out of the state. This will only harm consumers as it would place Kentucky’s licensed operators at a competitive disadvantage against unregulated alternatives and new federally regulated prediction markets. 
• HB 904 picks winners and losers, limiting consumer choice by preventing Kentuckians from using their preferred sports betting platform.
